Welcome to The Wine Doctor.

These Terms of Service ("Terms") govern your access to and use of The Wine Doctor website, online store and related services (collectively, the "Services").

In these Terms, "The Wine Doctor", "we", "us" and "our" refer to The Wine Doctor (ABN 83 117 449 760).

The Services are powered by Shopify, which provides the technology that enables us to operate our online store.

By accessing, browsing or using our Services, or by purchasing products from us, you agree to be bound by these Terms, together with any policies referenced in them, including our Privacy Policy and Refund Policy.

Please read these Terms carefully before using our Services. If you do not agree with these Terms, you should not access or use our Services.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

 

01 — AGE VERIFICATION

Eligibility and Access

You must be at least 18 years of age to purchase, receive or otherwise obtain alcohol through our Services.

It is against the law to sell or supply alcohol to, or obtain alcohol on behalf of, a person under 18 years of age.

By placing an order for alcohol through our Services, you represent and warrant that:

  • you are at least 18 years of age;

  • the information you provide to us is accurate and complete;

  • you are purchasing the products for lawful purposes; and

  • you will not purchase or obtain alcohol on behalf of a person under 18 years of age.

We reserve the right to request proof of age and may refuse or cancel an order where satisfactory proof of age cannot be provided.

We may also refuse service, cancel orders or restrict access to our Services where we reasonably believe that a customer has breached these Terms or applicable laws.

 

02 — PRODUCT INFORMATION

Our Products

We make reasonable efforts to ensure that product descriptions, images, pricing and other information displayed through our Services are accurate and current.

However, product colours, labels, packaging and appearance may vary slightly from images displayed on your device.

Product descriptions, specifications, availability and pricing may be changed or updated from time to time without notice.

We reserve the right to discontinue products, limit quantities or refuse orders where reasonably necessary, including where a product is unavailable, incorrectly described or cannot lawfully be supplied.

Any information provided through our Services about our products is provided for general informational purposes only and should not be interpreted as medical, health or professional advice.

 

03 — PLACING AN ORDER

Orders

When you place an order through our online store, you are making an offer to purchase the products selected by you.

An order is subject to acceptance and availability. We reserve the right to accept or decline an order at our discretion, including where:

  • a product is unavailable;

  • there is an error in product information or pricing;

  • we are unable to verify your age where required;

  • we reasonably suspect fraudulent or unlawful activity; or

  • accepting the order would result in a breach of applicable law.

Payment must be successfully processed before an order is accepted and fulfilled.

If we are unable to accept or fulfil your order, we will contact you using the contact information provided when placing the order and refund any payment received for products that cannot be supplied.

Please review your order carefully before submitting it. Cancellation requests after an order has been accepted may not be able to be accommodated.

Your purchases are subject to our Refund Policy and your rights under the Australian Consumer Law.

Unless otherwise agreed, products purchased through our online store are for personal use and may not be commercially resold.

 

04 — AT CHECKOUT

Prices, GST and Payment

All prices displayed through our online store are in Australian dollars unless otherwise stated.

The Wine Doctor charges Goods and Services Tax (GST) where applicable. GST treatment may depend on the product ordered and the applicable tax requirements.

Prices, discounts and promotional offers may change without notice. The price charged for an order will generally be the price displayed at the time the order is placed and will be confirmed as part of the order process.

We reserve the right to correct pricing errors, including where a product has been listed at an obviously incorrect price.

You agree to provide accurate and complete billing, payment, contact and delivery information and to keep that information up to date where necessary.

By submitting payment details, you represent that you are authorised to use the payment method provided.

 

05 — GETTING YOUR ORDER

Shipping and Delivery

The Wine Doctor currently ships merchandise to locations within Australia.

Delivery times provided through our Services are estimates only and may vary depending on location, carrier availability and other circumstances outside our reasonable control.

We are not responsible for delays caused by shipping carriers, weather, natural disasters, government restrictions, customs or other events beyond our reasonable control.

Where applicable, products are transferred to the shipping carrier for delivery to you. However, nothing in these Terms is intended to limit any rights or remedies you may have under the Australian Consumer Law in relation to delivery, loss, damage or defective products.

You are responsible for providing an accurate delivery address and ensuring that an appropriate adult is available to receive an alcohol delivery where required by law or the delivery provider.

 

06 — IF SOMETHING'S WRONG

Returns, Refunds and Faulty Products

If a product purchased from The Wine Doctor is faulty, defective or out of date, we will provide an appropriate remedy in accordance with the Australian Consumer Law and our Refund Policy.

Because of the nature of our products, we generally do not accept returns or provide refunds for products that have been opened or used where there is no fault or other legal entitlement to a remedy.

If you believe a product is faulty, defective or out of date, please contact us before returning the product so that we can provide appropriate instructions.

Any return or exchange will be handled in accordance with applicable law and our Refund Policy.

Nothing in this section limits your rights under the Australian Consumer Law.

 

07 — OUR CONTENT

Intellectual Property

Unless otherwise stated, all content appearing on or made available through our Services, including text, logos, trademarks, graphics, photographs, product images, designs, video, audio and other materials, is owned by or licensed to The Wine Doctor or its relevant licensors.

You may access, view, copy or print material from our Services for your own personal, non-commercial use, provided that you do not remove copyright, trademark or other proprietary notices.

You must not, without our prior written permission:

  • reproduce, modify or commercially exploit our content;

  • redistribute or republish our content;

  • create derivative works from our content;

  • use our trademarks or branding;

  • systematically download or extract content from our Services; or

  • use our content for commercial purposes.

All third-party trademarks, brands, product names and service names remain the property of their respective owners. Their appearance on our Services does not necessarily imply endorsement, affiliation or sponsorship by The Wine Doctor.

Third-Party Services and Links

Our Services may contain links to, or functionality provided by, third-party websites and services.

We do not control or endorse third-party websites and are not responsible for their content, availability, accuracy, security or privacy practices.

If you access a third-party website or service through our Services, you do so at your own risk and should review the applicable third party's terms and privacy policy.

Your use of third-party services may also be subject to additional terms imposed by the relevant third-party provider.

 

09 — OUR PLATFORM

Shopify

Our online store is hosted and powered by Shopify.

Shopify provides the technology infrastructure through which we operate our online store. However, purchases made through our store are transactions between you and The Wine Doctor.

Shopify is not responsible for the products we sell, their quality, condition, legality or our fulfilment of orders.

Nothing in these Terms is intended to impose liability on Shopify for matters for which The Wine Doctor is legally responsible, or to exclude any liability that cannot lawfully be excluded.

 

10 — YOUR DATA

Privacy

Your use of our Services is subject to our Privacy Policy.

We may collect personal information that you provide when you contact us, register your interest, subscribe to communications, place an order or otherwise interact with our Services.

We may also collect information automatically, including website traffic and usage information such as IP address, browser information and pages visited.

We use personal information to provide and administer our Services, process orders, respond to enquiries, provide requested information, communicate with you and, where permitted, provide information about products, services, offers and updates that may be of interest to you.

You may opt out of marketing communications at any time.

Where reasonably necessary to provide our Services, we may disclose relevant personal information to service providers, authorised centres, delivery providers, payment providers, technology providers or other parties involved in providing the Services.

We do not sell or rent your personal information to third parties for their independent marketing purposes.

We reserve the right to remove Feedback that we reasonably consider unlawful, misleading, offensive, inappropriate or inconsistent with these Terms.

We are not responsible for the content or opinions expressed in customer reviews or other user-generated content.

 

13 — IF WE GET IT WRONG

Errors and Omissions

From time to time, information on our Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or other information.

We reserve the right to correct such errors and update information where appropriate.

Where an error materially affects an order, we may contact you to provide the correct information or, where appropriate, cancel the affected order and provide a refund.

Nothing in this section limits your rights under applicable consumer law.

 

14 — MISUSE OF OUR SITE

Prohibited Use

You must use our Services only for lawful purposes.

You must not use our Services:

  • to breach any applicable law or regulation;

  • to purchase or obtain alcohol for a person under 18 years of age;

  • to provide false, misleading or fraudulent information;

  • to infringe our intellectual property rights or those of another person;

  • to interfere with the operation or security of our Services;

  • to upload or transmit malicious code, viruses or other harmful material;

  • to impersonate another person or entity;

  • to collect personal information about other users without authorisation;

  • to scrape, crawl, harvest or systematically extract data from our Services without our prior written permission;

  • to attempt to gain unauthorised access to our systems or accounts; or

  • to engage in any activity that may damage, disrupt or place unreasonable demands on our Services.

We may suspend or terminate access to our Services where we reasonably believe that these Terms have been breached.

 

15 — BOTS & SCRAPERS

Automated Access and Agents

You must not use automated systems, bots, agents, crawlers, scraping tools or similar technologies to access, monitor, copy, extract or interact with our Services without our prior written permission.

We may implement technical measures to restrict automated access to our Services.

Nothing in this section prevents legitimate search engine indexing or other automated activity that we expressly permit.

 

16 — SUSPENDING ACCESS

Termination

We may suspend or terminate your access to our Services where reasonably necessary, including where you breach these Terms, engage in unlawful conduct or misuse our Services.

Termination does not affect any rights, obligations or liabilities that arose before termination.

Provisions concerning intellectual property, privacy, liability, indemnification, governing law and any other provisions that by their nature should survive termination will continue to apply.

 

17 — NO GUARANTEES

Disclaimer

Information provided through our Services is intended for general informational purposes.

While we make reasonable efforts to ensure that information provided through our Services is accurate and current, we do not warrant that all information will always be complete, accurate, current or free from errors.

Product information should not be relied upon as medical, health or professional advice.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

 

18 — OUR RESPONSIBILITY

Limitation of Liability

To the maximum extent permitted by law, The Wine Doctor is not liable for loss or damage arising from your use of our Services where such liability may lawfully be excluded.

This may include indirect or consequential loss, loss of profits, loss of revenue, loss of data or business interruption, except to the extent that such liability cannot lawfully be excluded.

Nothing in these Terms excludes, restricts or modifies our liability for:

  • death or personal injury caused by our negligence where that liability cannot lawfully be excluded;

  • fraud or fraudulent misrepresentation;

  • breach of consumer guarantees under the Australian Consumer Law; or

  • any other liability that cannot legally be excluded or limited.

Where our liability can lawfully be limited, our liability will be limited to the extent permitted by applicable law.

 

19 — YOUR RESPONSIBILITY

Indemnification

To the extent permitted by law, you agree to indemnify The Wine Doctor and its officers, employees, contractors, agents and service providers against reasonable losses, liabilities, costs and expenses arising from your unlawful use of the Services, your breach of these Terms, or your infringement of the rights of another person.

This obligation does not apply to the extent that the relevant loss or liability was caused by The Wine Doctor's own negligence, breach of these Terms or breach of a non-excludable legal obligation.

 

20 — PARTIAL INVALIDITY

Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be read down to the extent necessary or, if it cannot be read down, severed from these Terms.

The remaining provisions will continue in full force and effect.

 

21 — OUR FULL AGREEMENT

Waiver and Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies expressly referred to in them, constitute the agreement between you and The Wine Doctor concerning your use of our Services and supersede any prior terms relating to the same subject matter.

 

22 — TRANSFERRING RIGHTS

Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations where reasonably necessary in connection with our business, provided that doing so does not unlawfully affect your rights.

 

23 — JURISDICTION

Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You and The Wine Doctor submit to the courts of New South Wales and the applicable Commonwealth courts of Australia in relation to any dispute arising from these Terms or your use of the Services.

Nothing in this section limits any rights you may have to commence proceedings in another jurisdiction where required or permitted by applicable law.

 

24 — KEEPING THIS CURRENT

Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements or other circumstances.

The latest version will be published on this page.

Where required by law, we will provide notice of material changes.

Your continued use of our Services after updated Terms are published constitutes acceptance of the updated Terms to the extent permitted by law.
